Foreign Direct Investments (FDI) and some foreigners are needed for Local Content to thrive in the Nigerian oil and gas industry and allied sectors, the Executive Secretary, Nigerian Content Development and Monitoring Board (NCDMB), Engr. Simbi Wabote has said.

The Executive Secretary spoke in Abuja on Thursday at a workshop organised by the Nigerian Electricity Regulatory Commission (NERC) on the Nigerian Content benchmark for schedules of products and services and local products exhibition for the Nigerian Electricity Supply Industry.

Wabote was represented by the Director Planning, Research & Statistics in the NCDMB, Mr. Daziba Patrick Obah and he explained that Nigeria is still lacking in some capabilities, hence the need for FDI to support Local Content growth.

He emphasized that Local Content philosophy and its application in Nigeria has no correlation with Nigerianisation or Nationalization of foreign firms.  “It is neither a Protectionism force nor anti-foreigners in its inclination, and must not be applied interchangeably with Corporate Social Responsibility,” he added.

Obah stressed that “Nigerian Content is a very serious stakeholder business initiative, designed to promote domestication and domiciliation of value adding activities in-country through manufacturing, procurement, research & development and employment & training.”

Shedding light on Board’s monitoring and enforcement of the provisions of the Nigerian Content Act, he disclosed that “our Monitoring and Evaluation Framework adopts a two pronged approach namely, Compliance & Performance Monitoring and Intervention Monitoring.”

He explained that in cases where cases of non-compliance or other infractions are established against some companies, the Board adopts measures which include litigation, naming and shaming, blacklisting from future tenders, remediation measures and others.

    Sir,
    VIOLATION OF NIGERIA OIL AND GAS INDUSTRY CONTENT DEVELOPMENT ACT 2010, ACT NO. 2; PUBLIC PROCUREMENT ACT 2007, ACT NO. 14 THE PRESIDENTIAL EXECUTIVE ORDER 005, 2018 BY MOBIL PRODUCING NIGERIA UNLIMITED WITH ACTIVE CONNIVANCE AND ACTIVE PARTICIPATING OF THE CNS MARINE: A CALL FOR THE REMOVAL AND PROSECUTION OF THE CNS INTERNATIONAL
    Mobil Producing Nigerian Unlimited awarded a long term maintenance contract which contained lifting, Diving and ROVs job to CNS International, a foreign Company from Italy against the letter of the extant laws and Presidential Executive Order 005, 2018 which is to the effect ‘’Operators and procuring entities’’ shall give preference to Nigerian companies and firms in the award of contract in Oil and Gas industry.
    Sir, the Presidential Executive Order 005, 2018, in its definition of terms, section 17 also defines a Nigerian Company to mean a company formed and registered in Nigerian in accordance with the provisions of the companies and Allied Matters Act C 20 LFN 2004, with not less than 51% equity shares by Nigerians.
    The Presidential Executive Order 005, 2018 further define Domestic firm as business or professional organization:
    a) Incorporated or otherwise organized in Nigeria
    b) Having its principal place of business locate in Nigeria; and
    c) Having at least 51% of its equity held by Nigerian
    d) Not having its assets controlled by foreign national or organization incorporated or organized outside Nigeria.
    e) With more than 50% of person who will perform services under the contract whether employed directly or by a subcontractor being nationals of Nigeria.
    Sir, Mobil Producing Nigeria Unlimited had given approval to CNS International, a foreign company from Italy to work in gross violation of our extant laws and especially the most revered Presidential Executive Order 005, 2018 which came to salvage the situation in our Nigerian Oil and Gas Industry.
    It is very strong that the perpetrators of this subversion of our extant laws and our most revered Presidential Executive Order 005, 2018 is not working in the interest of MPN, Oil Industry, the host community and our great country Nigerian. It is therefore not unnervingly difficult to perceive the ill motive of this cheap and unpatriotic act / omission by Mobil Producing Nigeria Unlimited, the NCDMB and the Department of Petroleum Resources in hurriedly giving approval to CNS International whom we strongly believe may not have the requirements of our extant laws especially:
    i. That of not having it assets controlled by foreign national
    ii. That is registering in line with companies and Allied Matters Act cap C20, 2004 which is to the effect that Nigerians must have more than 51% equity shares in Nigerian or Domestic Companies etc.
    We are requesting most respectfully that you please:
    a) Remove / sanction CNS International from Italy in line with the Order 005, 2018 which provides punishment for violations of Executive Order which shall be as stipulated by the Public service rules and relevant laws governing public procurement and professional practise in Nigerian.
    b) Cause an investigation to be carried out to ascertain the correctness or otherwise of our allegation.
    Our petition is in line with your avowed commitment to punish the violators of NOGICD ACT 2010
